Both older persons and those who havedisabilities can encounter discrimination whenthey seek medical care. Just as ageism andstereotypes about older persons mayinappropriately limit medical care for theelderly, limits may be placed on medical carefor those who are disabled simply because ofthe presence of a disability. At the sametime death is the natural end of the lifespanfor all individuals and there are situationswhen aggressive medical care is not indicated. It is not right to always insist on ``doingeverything'' for a person even (...) if that personmay be at risk otherwise for discrimination. Using the example of the elderly, this paperexamines the risks of discrimination and thedangers of overtreatment in caring for olderpersons and suggests parallels in theappropriate care of those who havedisabilities. For the past 3 years, since acquiring formal training in healthcare ethics and philosophy, I have been one of those physicians who “does” ethics. I teach medical students and residents, write articles, speak at conferences, chair an ethics committee, and informally consult with colleagues on cases where they request advice related to ethical issues in the care of patients. These activities have been a rewarding and challenging part of my practice. There has also been a fair amount of frustration. Unfortunately, (...) both in teaching and patient care, it has been a frequent experience to finish a discussion with physicians only to be told that what I said was nice but had no bearing in the real world. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

A laboratory-testable, solid-state Maxwell demon is proposed that utilizes the electric field energy of an open-gap p-n junction. Numerical results from a commercial semiconductor device simulator (Silvaco International–Atlas) verify primary results from a 1-D analytic model. Present day fabrication techniques appear adequate for laboratory tests of principle.

Myles Burnyeat maintains that Aristotelian epistêmê, in so far as it deals with explanations, is properly identified as understanding rather than as knowledge. Although Burnyeat is right in thinking that the cognitive achievement Aristotle typically has in mind is not justified true belief, Aristotelian epistêmê cannot be equated with understanding. On some occasions in Aristotle’s writings (e.g. Apo 71a4), the term designates a particular science such as mathematics; on others (e.g. Apo 72b18-20), it designates the grasp of a first (...) principle; on others (e.g. Apo 94a20) it is a systematic grasp of fact and explanation that is properly termed understanding; and on still others (e.g. N. Ethics 1147a22) it is that combination of factual knowledge and competency in demonstration that qualifies as ‘expertise’ or ‘disciplinary mastery’. (shrink)

The paper by Dr. Myles Sheehan “Why Doctors Hate Medical Ethics” highlights some of the problems of teaching ethics to an extremely weary group of house officers who may look at ethics as a waste of time, as a requirement that must be overcome, or as “a lot of crap” Although Dr. Shee-han's paper offers a number of interesting and valuable insights, it really fails to say why residents hate the teaching of medical ethics any more than they (...) may hate any other conference which, inevitably, intrudes on their time. In this response, I do not so much want to take issue with Sheehan's paper as to comment and to offer some of my own experiences teaching ethics. To do so, I am fully aware, may be regarded as matching anecdote with anecdote, a tiresome and ultimately futile process. (shrink)

Thus far, little work in bioethics has specifically focused on global health research priority-setting. Yet features of global health research priority-setting raise ethical considerations and concerns related to health justice. For example, such processes are often exclusively disease-driven, meaning they rely heavily on burden of disease considerations. They, therefore, tend to undervalue non-biomedical research topics, which have been identified as essential to helping reduce health disparities. In recognition of these ethical concerns and the limited scholarship and dialogue addressing them, we (...) convened an international workshop in September 2015. The workshop aimed to initiate discussion on the appropriate relationship between global and national levels of health research priority-setting and to begin exploring what might be ethically required for priority-setting at each of those levels. This paper comprises our reflections following the workshop. Its main objective is to launch a research agenda for the ethics of global health research priority-setting. We identify three domains of global health research priority-setting—scope, underlying values and substantive requirements, and procedural considerations. For each domain, specific research questions are highlighted and why they need to be explored is explained. Some preliminary thoughts and normative arguments as to how the research questions might be answered are also offered. For example, we provide initial ideas about the appropriate relationship between different priority-setting levels and what values and substantive considerations should guide or underpin global health research priority-setting as a matter of justice. We anticipate that framing a new research agenda for the ethics of global health research priority-setting will spur ethicists, researchers, and policymakers to refocus their efforts on developing more rigorous and ethically sound approaches to priority-setting. The relationship between ethics and trust is ambiguous as ethics can promote trust, whilst trust can simultaneously be abused resulting in unethical behaviour. In this contribution to the debate on trust and ethics the focus is specifically on the role that ethics can play in facilitating trustworthiness. The article starts with a definition of the concept trustworthiness. It then reports on an empirical longitudinal study on trustworthiness that was conducted in a South African company in the insurance industry. The facilitators (...) of trustworthiness that were identified in this study and their relative contributions to trustworthiness are then discussed. Finally the implications of these findings for the ethical conduct of managers are discussed. It is demonstrated how ethical managerial conduct can enhance the trustworthiness of managers. (shrink)

The counterfactual analysis of event causation. 5. The role of free agency. 6. Causality in the human sciences. -- The reasons vs. causes debate reached its peak about 40 years ago. Hempel and Dray had debated the nature of historical explanation and the broader issue of whether explanations that cite an agent’s reasons are causal or not. Melden, (...) Peters, Winch, Kenny and Anscombe had contributed their anticausal conceptions. The neo-Wittgensteinians seemed to be winning the day when in 1963 Donald Davidson published his seminal paper “Actions, Reasons, and Causes”. Davidson’s paper devastated the Wittgensteinian camp. It contained, among other things, a powerful attack on the logical connection argument. Davidson argued that the existence of a logical or conceptual connection between descriptions can never eliminate a causal relation, which holds between events simpliciter, not between events under certain descriptions. Davidson maintained that in a way, reasons can be causes. When somebody acts for a certain reason, his intentional attitudes, or rather changes in his attitudes, cause his bodily movements. Davidson also argued that rationalization is a species of causal explanation. For the definition of action, he argued that intentional actions are bodily movements caused in the right way by beliefs and desires that rationalize them. Davidson’s paper paved the way for causal theories of action, which superseded neo-Wittgensteinian analyses in the following decades. The causal theory was rapidly adopted by Alvin Goldman, David Armstrong, Paul Churchland, Myles Brand and many others, entering the mainstream and dominating the philosophy of action to this very day. In 1971 Georg Henrik von Wright published his book "Explanation and Understanding". The second chapter did not deal with agency, but with causation. It developed a new account of causation, the interventionist or experimentalist account. Focusing on causation, von Wright remedied a major shortcoming of the reasons vs. causes debate. The concept of causality, and the nature of the causal relation, received little attention in this debate, a fact that holds true for both camps. Mostly it was simply taken for granted that, as Hempel had declared, “causal explanation is a special type of deductive-nomological explanation”. One camp then aligned intentional explanations with D-N explanations, while the other camp insisted on their disparity. So strictly speaking, the label “reasons/causes debate” was a misnomer. The controversy dealt primarily with the question as to whether intentional explanations can take the form of D-N explanations, while the notion of causation, and the metaphysics of the causal relation, were left obscured. With von Wright’s new approach, the situation changed. Von Wright was primarily concerned with causation, but his approach contained an implicit attack on the causal theory of action as well. His core idea was that the notion of causality is intimately linked with, or even derived from, the notion of intentionally making something happen. Other philosophers, even Hume, had considered such a connection before, but often just to reject this view, regarding it as a kind of myth belonging to the infancy of the human mind. Von Wright took the idea seriously. He submitted the analysis that p is the cause of q if and only if by doing p we could bring about q. The causal theory of action was also concerned with the relation between causation and agency, to which its name bears witness. The causal theory of action holds that actions are bodily movements with a certain causal history. This is why von Wright’s account constituted a momentous challenge to the causal theory: it reversed the direction of conceptual dependency between both notions. Davidson and his followers tried to define what an intentional action is by using the notion of causation. The causal condition which the causal theory sets is part of the definition of “doing something intentionally”. Von Wright claimed that the conceptual dependency is the other way round. He used the notions of doing, and bringing about, to explain what causal relations are. So, instead of a causal theory of action, he advocated an agency theory of causation, as it may be dubbed. It is remarkable how seldom this clash of opinions about conceptual primacy is reflected in the literature. There are few exceptions: Fred Stoutland noticed the conflict, and he published a number of papers in which he compared Davidson’s and von Wright’s views. Von Wright’s book "Explanation and Understanding" was widely read and discussed in the seventies, especially in Europe. But it strikes me that especially in North America, where the causal theory of action became the orthodoxy of the day, von Wright’s challenge went largely unnoticed. Even Davidson did not seem to take it seriously. He nowhere takes notice of the interventionist theory of causation, while he does discuss von Wright’s earlier book "Norm and Action". As is well-known, Davidson favoured an alternative account of causation, based on “the principle of the nomological character of causality”, as he somewhat clumsily called it, or, later and less clumsily, “the cause-law thesis”. Davidson’s firm adherence to a nomological theory of causality may explain why he did not take much interest in alternative accounts. [...] -/- . (shrink)

Courts and jurors sometimes refuse to assign liability to defendants on the basis of statistics alone, despite their apparent reliability. I argue that this refusal is best understood as a recognition of defendants’ right to security. Understood as a robust good in Philip Pettit’s sense, security requires that someone risking harm to others’ protected interests adopt a disposition of concern that controls against wrongfully harming them. Since trials risk harm, the state must adopt such a disposition. Statistics leave open the (...) possibility of innocence and so wrongful harm in a way that the state cannot ignore; if it does use such statistics, it makes defendants wrongfully insecure. This explanation of the problem of bare statistical evidence is especially apt because security grounds the right to a fair trial and judicial procedural rights more generally. (shrink)

The paper develops value based management guidelines from the famous Indian treatise on management, Kautilya's Arthashastra. Guidelines are given for individual components of a total framework in detail, which include guidelines for organizational philosophy, value based leadership, internal corporate culture, accomplishment of corporate purpose and feedback from stakeholders.

Thus, Sheehan has brilliantly shown both Rahner's indebtedness to Heidegger (especially his notion of the human person as a bivalent and kinetic being; note the parallels between Rahner's cogitative sense and Heidegger's Temporalitiit, between Rahner's agent intellect and Heidegger's Existentialitiit, between Rahner 's possible intellect and Heidegger's Faktizitiit) and (...) Rahner's profound differences from Heidegger, especially in his understanding of being (see pp. 110-116; 280-291). Finally, Sheehan has provided the clearest exposition to date on Rahner's theory of " inner-worldly efficient causality " (pp. 244-255). The book would have been much more helpful if an index of topics and a bibliography had been provided. There are two omissions. On p. 135, the last line should read: " Chapter VIII concludes the study by laying out the critical difference between Rahner's effort to re-establish the science of metaphysics on a transcendental base and Heidegger's attempt to overcome metaphysics." On p. 186, line 19: "In whatever way we read the content of predicate (Aquinas: quiddities)." There are also a number of minor misprints. Strange that this book was published only in 1987, even though the research was apparently completed before 1982 (see p. 171, note 62). But its many assets will make Sheehan's work a permanent feature among the best Rahnerian studies. The Catholic University of America Washington, D.C. PETER c. PHAN The World and Language in Wittgenstein's Philosophy. By GORDON HUNNINGS. Albany, N.Y.: State University of New York Press, 1989. Pp. xiv +266. $34.50. This book will not find a place among the distinguished commentaries on Wittgenstein's work. Aiming to cover the full sweep of that work, Hunnings devotes three of his eight chapters to the Tractatus, one to the" Notes on Logical Form" (1929) and Philosophical Grammar, one to the transitional material of The Blue and Brown Books, one to writings and lectures on the philosophy of mathematics, and just two to the central themes of the later philosophy. Indeed, of the book's 256 pages of text, 193 are spent before the reader finds himself dealing with Philosophical Investigations. So there is a problem of balance. For a book of this size and scope striving to cover the whole of Wittgenstein's BOOK REVIEWS 555 thought on representation and grammar, there is too much exposition of transitional detail and too little attention to the difficult but fertile work at the heart of the mature later Wittgenstein. There are now many fine expository studies of Wittgenstein's work. This is not to say that all important matters of interpretation are settled. Indeed, there are significant areas of rival interpretation and there are varying assessments of the adequacy of Wittgenstein's views. There is contention over the degree to which his work is assimilable to the philosophical tradition. These facts suggest, not that there is no profit in further investigation of his work, but that new studies-particularly ones attempting a comprehensive survey of Wittgenstein's work from the Notebooks to On Certainty-should situate themselves in a well cultivated terrain of commentary and interpretation. But Hunning's work does little to inform prospective readers of the extent to which scholarly study of Wittgenstein's work has advanced. Eschewing a bibliography, Hunnings makes it somewhat difficult for the reader to discern his command of the scholarship. In construing the Tractatus he relies on Anscombe, Stenius, Griffin, and Black-all standard sources. But in dealing with the later philosophy and the much-debated transitional period between Wittgenstein's resumption of philosophical work in the late 1920's and the period of the Investigations, Hunnings simply does not scratch the surface of the huge body of secondary writing available to serious students of Wittgenstein's work. It would be pointless to list the important commentators whose works are ignored; suffice to say that Hunnings's book is apparently unassisted by a full scholarly command of the available literature.
